The Prenuptial Agreement Dilemma

Monday, April 28th, 2008

By Jeffrey Broobin Should we have a prenuptial agreement? OK. You can look at the idea as very cold and unromantic. You can look at the idea as a considerate and practical way to decide before the marriage certain issues having to do with your money. It is interesting to note that the custom of creating prenuptial agreements is not the modern invention that it seems to be. During the 19th century, before the Married Women’s Property Act of 1848, prenuptial agreements were necessary for women in the United States. Until the act became law, everything a woman owned or inherited was transferred to her husband. If he died or divorced her, she was just out of luck. Nowadays it is not so uncommon to execute prenuptial agreements. And these are not just for the famous super-rich couples we read about, where one spouse is much richer than the other. These are couples who want to be upfront about financial issues and get that out of the way before the wedding. A prenuptial agreement is a signed and notarized contract that describes how a couple will handle the financial aspects of their marriage. The prenuptial agreement has many positive benefits that are not related to divorce, and although it is not very romantic, it has many positive elements. If a future spouse won’t sign a prenuptial agreement, it may be best to discover this before the wedding. The financial well-being of children from a previous marriage can be protected Personal and business assets accumulated before the marriage are protected by a prenuptial agreement. A prenuptial agreement reveals financial expectations before the wedding. A prenuptial agreement discloses assets a spouse may want to give to children or other family members in the event of death. In the event of a divorce, the prenup eliminates battles over assets and finances. Signing a prenup does not mean that a couple is anticipating divorce. Prenups address financial matters need to be faced. A well-constructed prenuptial agreement can preserve family ties and inheritance. Despite its many positive features, the prenuptial agreement cannot accomplish everything. A prenuptial agreement may be considered unromantic. A prenuptial agreement may give the appearance of a lack of trust between the partners. It is true that a prenup could create resentment between certain spouses. Certain requirements exist so that the prenuptial agreement cannot be declared invalid. These include failure to disclose all assets, evidence of fraud, forcing the agreement upon the other spouse, unfairness, and lack of representation at the time of signing the agreement. If you are considering having a prenuptial agreement it is important to remember these things: Dont wait until the last minute to talk about financial matters. Discuss the agreement early in the relationship. Dont try to hide your thoughts, feelings, and especially your assets. Bringing Your Individuality to Work: Brilliant or Taboo?

Saturday, April 26th, 2008

By Elizabeth Mcaloon Personal branding is the latest buzzword. Its a topic that cuts across a number of career management areas. The concept can be extremely helpful, but the language leaves many people feeling that theres a big mystery out there about how to be successful. Lets demystify it right now! There are products, and there are brands. Whats the difference? Well, a brand is made up of all the intangible associations that go along with a particular product: the romance of Chanel No.5; the sexiness of a Ferrari; the cachet of a Rolex. To the working world, you are, in part, a product. Sure, youve got that dazzling smile and youre the one everyone wants to sit next to at the holiday partythats part of the product. But its more than that. Your brand is the unique special recipe of youyour experiences, skills, personality, talents, creativity, wisdom, ability to connect with people. It all adds up to what you specifically add to an organization.Ive asked dozens of people about their brand, and very few can convey it with any clarity. Personal branding is not your title. Personal branding is the youness that you bring. Its not necessarily what you do, but the particular way you do it. Lets look at some examples: Bob comes from an Ivy League background. He likes to manage largely by the number goals. Even though his door is physically open 90% of the time, he generally prefers his team to make appointments with him to talk. He loves reports and frequently has a large stack of them on his well-organized desk. Hes known to be fair and consistent and respected by his team. Hes comfortable with upper management and is invited to join them for lunches and ball games. Bob has the uncanny ability to look at a process and immediately find the clogged pipe in the system. He is decisive and he acts quickly. Bob always looks very professional and speaks with confidence. He never loses sleep over his decisions. Hes typically the first to arrive in the morning and among the last to leave at night. His office decor consists of certificates, degrees, and some photos of his last college alumni rafting trip. He has a quote from Demming (one of the masters of process management) on his bulletin board. What adjectives describe the image you are getting of Bob? Jill went to a state college and likes to manage by developing close, friendly connections with her customers and her team. Her door is always open and sometimes theres music coming from her office. Theres always a dish of candy on her desk. Her work area is typically a bit messy and there are a bunch of Post-Its on the wall by her phone. Jill has an amazing ability to find creative ways to improve processes, especially in the area of customer service. Her team frequently seeks her out to get her input, celebrate wins, and brainstorm. Talking to Jill keeps her team invested in their work. Higher-ups dont know quite what to think about Jill, but they do know that whatever shes doing, its innovative and it works. Shes outgoing, highly expressive, and prone to wearing artistic jewelry. Her bulletin board features smiling photos of herself and her team and customers at various fun events. Jill is often half an hour late in the morning and usually leaves early on Fridays. What adjectives describe the image you are getting of Jill? If you saw only their titles and the revenue results of their departments on a resume, youd be hard-pressed to know who they really arewhat they contribute to the organization. The truth is that they are both outstanding, but vastly different, managers. They each bring something unique. Bob brings consistency, reliability, expertise in process analysis, a traditional approach to setting boundaries with staff, an ability to speak the language of upper management. Bob is great at executing and preserving well-developed processes. He will also ensure that his team understands and honors this goal as well. All of these things may help Bob get his team more resources, raises, bonuses, and recognition. Customers feel certain that Bob will find and fix problems quickly and efficiently. Jill brings vitality to the organization. Her team and customers connect with her, which in turn motivates them to cooperate with each other. Her confidence in her team is based on knowing who they are as individualstheir strengths and potentials. Her mindset of continuous innovation helps the organization stay ahead of the competition in providing new services and products. Her collaborative nature stimulates creativity and productivity in the group. Customers feel certain that Jill really cares and is vested in their happiness and success. What do you bring? Remember, your brand is the unique way you do what anyone with your job title does. Whats your personal brand? How has your personal brand contributed to your success? Can people sense your brand? Does your choice of language mirror your brand? Does your personal image? Your communication style? If youre in a career transition, have you communicated your brand throughout your resume and cover letters? Sit back and observe yourself, or ask a colleague or friend to help you. Consider hiring an executive coach who works with executives on personal branding. Define your personal brand, communicate it, and live it. Get A Memory Foam Mattress and a Relaxing Sleep

Thursday, April 24th, 2008

By Terry Price Many diseases and illnesses in today’s society result from the lack of sleep, so be sure to get a good bed, maybe with a memory foam mattress. Insomnia can result in irritability, mental distress, anxiety disorders and depression. If you are the type of person that is not getting enough rest, try to make sleep your top priority as studies have shown that poor sleeping patterns over the years may cause depression later in life. Changes in sleep patterns can be the result of depression where you may experience difficulty in getting to sleep and their waking up early in the morning. A memory foam mattress will help with your total relaxation. Although medical science believes that insomnia may be related to mental disorders, it is not proven. There are numerous physical consequences as a result of sleep deprivation such as droopy eyelids, hand tremors, sensitivity to pain, and problems with focusing the eyes. Since our bodies react to fatigue in different ways, endurance and muscle strength are affected differently. Get your muscles beautifully relaxed on a memory foam mattress. Because the lack of sleep is due partly to a lowered glucose metabolism, it often leads to an increase in appetite. People that work a night shift are reported to not live as long as day workers, because they are constantly changing their sleeping patterns. Sleeping patterns are referred to as circadian rhythms, which are physical and mental changes that occur throughout the day and are caused by the body’s biological clock. A night worker’s schedule will disrupt this and often coronary heart disease is linked to shift workers. If you are sleep deprived, it is shown that the body’s ability to regulate insulin production and sugar metabolism may be dramatically affected and increase the risk of diabetes. The lack of sleep can also affect your immune system to make you more liable to catching colds and other serious diseases. Having a good night’s sleep should be on the top of your priority list and getting yourself a memory foam mattress should be, too. Musical Vibrations: A Great Tool Of Diverse Therapies

Sunday, April 20th, 2008

By Dr Julie Trudeau Everything vibrates. Everything in the body vibrates, all at its own special frequency. This is a scientific fact. When we are thrown out of balance through physical, emotional or psychic shocks, parts of our bodies and psyche can weaken or overload, creating distorted and unbalanced vibrations. Through the pioneering work of auditory psychic Sharry Edwards, Vibrational Sound therapy (called Bioacoustics in America) has been developed. Low frequency sound waves (generally below 50hz) are fed back to the body via the brain and re-mind the body where it has become out of balance, what the original healthy frequency was. When the low frequency sound waves that you most need are played back to you, they balance these peaks and troughs to bring the mind and body back to a harmonious state. In this state, the healing can take place. The sound waves are actually vibrating the areas where the energy has become low or distorted, reminding the brain and body of the healthy vibration that was originally there before the problem began. Thus Vibrational sounds are used as a tool of therapy. Various researches are going on this area. Digital Music and Musical Vibrations deal in various kinds of therapies. Dr. Julie can explain the role of Musical vibrations and the Digital Music in various kind of therapies. To know more about Digital Music, visit Dr. Julie. Keeping a Journal For Garden Planning

Saturday, April 19th, 2008

By Monica Resinger This is the time of year when the seed and plant catalogs come pouring in and we can browse through them and start dreaming up our gardens for the current year. A little planning will help you get what you want out of your garden and save you some time, money and frustration. A garden journal can be a very valuable tool when planning your garden. You can keep your garden journal in a spiral bound notebook, or anything that appeals to you. The bookstores have journals made especially for your garden if you want to get fancy. The first thing you want to do when planning your garden is to figure out what you want out of it. A great way to do this is to ask yourself some questions and take note in your journal. Some questions to ask yourself are: ~ Do you want fresh vegetables on the dinner table through summer, or do you want more than that for canning or freezing? ~ Would you like some fresh herbs to compliment those vegetables, make herbal teas or to give as gifts? ~ Do you want your yard to be colorful with seasonal flowers and would you like extras for cutting and putting in vases to decorate your home? ~ Do you want your flower beds to have flowers, vegetables, herbs and fruit, or only flowers? ~ Is there some new plant you want to grow? ~ Where will you plant all that you want to grow? ~ What style of garden do you want–cottage, formal, informal, etc.? ~ Do you want to save a little money by starting seeds, or do you want to save a little time by purchasing plants? ~ How many plants will you need for a certain area? ~ Do you have time to take care of all that you want out of the garden? A way to get ideas for your dream garden is to find pictures in magazines or catalogs that appeal to you. You can paste these pictures into your journal, or keep them in a folder nearby. When driving around town, look at others’ yards and try to remember what you liked about them. Take notes on what appeals to you. Once you know what you want by asking yourself the questions above and taking note on what appeals to you, you get to make the decisions of which plants to grow. This is where the catalogs can be a valuable tool. You can also use gardening books. The catalogs and gardening books will list plant names, whether or not it will grow in your zone, plant size, plant care and other information such as flower color. Once you have planned which plants you are going to grow where, you’ll need to purchase the seeds or wait until the nurseries start selling plants. You can also put a plant order in through a catalog and they will ship them to you at your planting date. This can be very convenient. If you are going to start seeds, it’s wise to figure out starting dates and write them onto your calendar or into your garden journal. To figure out when to start seeds, find out the number of weeks for germination time on the seed packet and count back that amount from your last frost date. Your journal can be a valuable tool next year when making plans. Don’t limit yourself to only writing in your journal now. You can also keep notes through the year on how well certain varieties of plants did for you, new plants to try, and anything else that will help you in your gardening efforts. Writing and reading your journal adds another fun dimension to gardening–try it, I think you’ll like it! The Basics of Bass Fishing

Wednesday, April 16th, 2008

By Anthony Lee If you are looking for a wonderful recreational sport that will take you far away from your comfort zone, look no further than bass fishing. The sport of bass fishing has quickly risen into the ranks of a multi billion dollar industry. This fishing sport has acquired a great following throughout the years and is now one of the most popular sports in America. This fact is no accident. While bass fishing is done all around the world, its popularity in America stems from the fact that the most popular types of bass fished for sport can be found in multitudes in the waters of North America. Bass fishing in America is so popular that bass fishing masters have become household names among American sports enthusiasts. Perhaps it is the lure of going back to basics and getting in touch with man’s hunting urges in nature that lures millions upon millions of individuals to this wonderful world of bass fishing for sport and recreation. If you are new to this sport or if you are only beginning to think about taking up this hobby, the whole concept of fishing may be a little daunting. Fortunately, what general knowledge we all have on fishing, applies for the sport of bass fishing. The exciting task of catching bass is done with a hook line and sinker. If you are looking for bass fishing techniques, look no further than that. Of course if you are a bass fishing enthusiast looking to improve your performance in the sport, you will be looking for bass fishing techniques but really, bass fishing is quite simple. First, this is so because bass fish are bountiful in certain waters, especially in North America so you can be sure that if you head on out to bass filled waters you are sure to catch a few. What counts of course is to catch bass fish of a certain size and weight. In this regard, the bass fishing technique to utilize is common sense. First of all, make sure that your fishing equipment is suitable for the type and size of bass you are hoping to catch. Remember also that bass fish particularly the big mouth and small mouth are feisty fish that serve the purpose of wonderful gaming fish. The large mouth bass is highly resistant to captivity and once hooked, you may have a hard time reeling it in because it will tend to hide behind submerged structures such as logs and seaweed to avoid being caught. The small mouth on the other hand is known to be jumpy once it hits the surface to be able to escape the grip of the hook. This is where your bass fishing technique of reeling the game in will come in handy. Also, because bass is a feisty fish resistant to capture, anglers are used. Anglers is the term for angled hooks used to catch the fish. There are several types of bait you can use, depending on your own preferences and bass fishing techniques. You may opt to use live or artificial bait and both actually work fine. Some artificial baits work better than the others and to find out which ones are more effective, you can read up on user reviews from bass fishing forums or ask your trusted fishing buddies for their recommendations. Of course, nothing beats the learning from actual experience so don’t be shy, get out there and compile your very own bass fishing techniques. Career Advice: What’s Happened To Your New Year’s Resolutions?

Monday, April 14th, 2008

By Ramon Greenwood Over one-fourth of 2006 is history. What did you accomplished in this quarter of the year toward fulfilling your New Year’s Resolution? If you are like most people you will have fallen behind in accomplishing your resolutions for 2006 or abandoned them entirely. That is a harsh reality, not easy to face. But it’s not too late to make the effort to turn your good resolutions into accomplishments. A New Year Begins Today There are 10 actions you can take to help turn your resolutions into achievements by the end of the year. 1. Make certain the goals you have set for 2006 are in fact realistic and attainable. They should be a real stretch, but reachable with your best efforts. Its fine, for example, to resolve to win a big promotion, but it’s not realistic to expect to make it all the way to the top in one leap. If upon sober reflection any one or all of your resolutions seem unrealistic or if your career goals have changed, do not hesitate to make a new set of resolutions for the remainder of 2006. Begin a new year today. 2. Take a hard look of what happened to your resolutions in 2005. Learn from your accomplishments and failures. 3. Make a plan and work it. Quantify each goal. Be sure to include actions to be taken with deadlines, as well as practical ways to measure progress at least once each month. 4. Put unrelenting pressure on yourself to make progress toward your goals every day. Accept no excuses for failing to meet deadlines. 5. Treat your resolutions as a binding contract with yourself. Put the contract in writing. Post the document in a prominent place so it will be seen every day. (The bathroom mirror is a good place.) Share your resolves with other persons you respect. 6. Reward yourself for progress. Enjoy what you have accomplished. 7. Don’t be discouraged by the sheer size of the challenges. Think of each resolution as a series of small, manageable tasks to be accomplished one by one. 8. Have a low tolerance for diversions. Permit them only if they are advancements toward achievements that are more important than the original goals. 9. Start now, this day. Dont let the time slip by until its too late and another year has gone by lost forever without measurable progress toward our goals. Take seriously this admonition from Marie Edgeworth: There is no moment like the present. The man who will not execute his resolutions when they are fresh upon him can have no hope from them afterwards; they will be dissipated, lost and perish in the hurry and scurry of the world, or sunk in the sloth of indolence. 10. Remember. Nothing provides greater rewards in terms of material benefits and peace of mind than having a set of goals and feeling at the end of each day that you have made your best efforts, according to a plan, to reach them. Teen Body Building

Friday, April 11th, 2008

By Jennifer Bailey Bodybuilding is not confined to male and female adults alone. Teenagers can also work out. Many teens nowadays want to have healthier, more beautiful bodies. To achieve this, they stick to a regular regimen of bodybuilding exercises. If you are one of those teens who want a perfectly toned body, it is most likely that you go to the gym every day. As time passes, you slowly achieve the look you want. What you dont realize is that when you work out, you develop not only on your physique, but your total personality as well. Teen bodybuilding is an effective way to improve oneself. This can certainly help you achieve your goal of having a beautiful body. However, bodybuilding itself is not only a matter of improving your physical appearance. It also enables you to apply the determination and patience you have in working out to the different aspects in your life. You have to keep in mind that a good-looking body is only temporary. What is essential is a healthy, more focused personality that strives for perfection. When you decide to go and build your body, you must have enough self-discipline and drive to achieve the results you want. It is no good for you to work out now then give up tomorrow. It is also not healthy for you to work out for a month, stop the next month, and then start working out again afterwards. Reaching your bodybuilding goals entails the strength of will to stick to your exercise regimen once you start. In bodybuilding, you must have the dedication to perform your exercises regularly and, of course, properly. Bodybuilding can help you become a well-rounded individual. You just have to set your goals, prioritize, and keep a positive attitude. The Stately Adirondack Chair - The Perfect Gift

Thursday, April 10th, 2008

By Jennifer Akre We all strive to meet our goals in life, making the celebrations that come after the hard work that much more enjoyable. What better way to show someone you respect their effort than by giving a gift which provides the perfect opportunity to relax? A simple yet elegant Adirondack chair not only provides the means to relaxation, but also presents a gift that the recipient will not soon forget. So often it is just too easy to take a moment to enjoy the scenery. With bills that need to be paid, children that must be bused from school to practice to home, we rarely take a minute for ourselves anymore. Sometimes, this investment in stress relief must be given, rather than purchased ourselves. Take for example the newlywed couple that is starting down a new path together. Their success as a couple hinges upon the ability to communicate and keep a balanced lifestyle. Adirondack chairs can help provide this balance and offer the happy couple a place to get away from it all after a long hard day at work. Regardless of their personal style, Adirondack furniture comes in a range of style to fit the traditional look of a turn of the century home, or a more modern sleek look of a city apartment. The material used to create this gift is also important. Adirondack furniture constructed of inexpensive pine is the perfect way to provide a whole set of patio furniture without the breaking the bank. Cedar and Teak woods, on the other hand, provide durability for years to come, and require little maintenance. The possibilities are limitless with painted outdoor furniture, making an artistic statement by contrasting against the organic tones found in nature. Once children enter the picture, time to relax becomes a distant memory. But, this separation of children from stress relief is often not healthy, making parents feel guilty for taking a moment for themselves. However, giving the gift of a child-sized premium Adirondack chair can remove this reasoning from the household and make a quiet night out on the deck a life-long family tradition. As children grow and begin families of their own, that same Adirondack chair and family tradition can be passed to the next generation. With a world that moves at the speed of light, we take for granted the little things in life. Our busy schedules become an excuse to make more money, and spend less time with the ones we love. But, the gift of a stately Adirondack chairs can be a cherished gift that can make people grateful for the simpler pleasures in life. Marriage: Traditional vs Equal - What is the Difference?

Monday, April 7th, 2008

By Cat Tobin Traditional Marriage is a term that you surely have heard, while the definition may be unique to each person, the general summation of the term has one partner working and supplying for a family while the other stays at home cleaning and taking care of the family. Todays world traditional marriage has become less frequent with the immergence of the equal marriage. An equal marriage is not inherently the opposite of a traditional marriage, but still remains very different. Here, both partners work outside of the home and expect equal duties when it comes to the home and family. Money is considered our money providing both partners the same control over the funds, even if different banking accounts exist. Despite the monetary contribution figures, there is no tab kept when it comes to who pays the bills more. This makes no difference, because the money is our money. When it comes to spending the money in an equal marriage, purchases and time of purchases become mutual decisions. Debt situations are also mutual decisions. Purchasing decisions usually pertain to bigger purchases. Money is the obvious contingent in an equal marriage but not the only. Household chores are also considered. There are no rules on the division of housework or similar duties. Rules can be set, letting the only discrepancy to be the quality of the work. When children exist in an equal marriage neither partner is designated the role of primary caretaker. It is important to remember that neither partners job is of greater importance than the other. Each partner is to consider their work situation and divide the duties in accordance to their ability to spend time doing the caretaking. This may be the hardest part of participating in an equal marriage. But if a proper schedule can be determined an equal marriage can be a successful relationship that can encompass all of the important aspects of the traditional marriage.
